This is a genuine, substantive starting point, not a placeholder - but it isn't a substitute for review by a qualified solicitor before relying on it at scale, particularly the liability and professional-responsibility sections below.

1. Acceptance of these terms

By creating an account or using Aeriva, you agree to these terms. If you don't agree, please don't use the service.

2. What Aeriva is

Aeriva is a survey, design, and quoting tool for heat pump and heating installers. It provides calculations, data lookups, AI-assisted analysis, and document generation to support your work - it does not replace your professional judgement, training, or responsibility as a qualified installer.

3. Your account

You're responsible for keeping your login details secure and for all activity under your account. Let us know immediately if you believe your account has been accessed without authorisation.

4. Free trial and paid plans

  • New accounts start on a free trial: one project, fully usable, for 14 days from account creation
  • After 14 days, or if you attempt to create a second project, you'll be asked to upgrade to continue creating or editing projects
  • Your existing trial project remains viewable after the trial period ends
  • Paid plan pricing and terms will be confirmed separately when self-serve billing is introduced

5. Your responsibilities as a professional user

Aeriva provides calculations and recommendations (heat loss estimates, radiator sizing, heat pump matching) as decision-support tools. You remain responsible for:

  • Verifying all calculations, measurements, and equipment recommendations against your own professional judgement and any applicable standards (including MCS requirements) before relying on them for a real installation
  • The accuracy of data you enter, including customer details and survey measurements
  • Compliance with your own regulatory, certification, and legal obligations as an installer
  • Obtaining any consent needed from your own customers before entering their personal data into the platform

6. Acceptable use

You agree not to use Aeriva to store or process data you don't have the right to hold, to attempt to disrupt or gain unauthorised access to the service, or to use the platform for anything unlawful.

7. Third-party services

Some features rely on third-party services - the UK EPC register and Google's Gemini AI, among others. We aren't responsible for the accuracy, availability, or output of these third-party services, though we aim to surface their results clearly and let you verify anything important.

8. Intellectual property

Aeriva and its underlying software remain our property. Data you enter (your projects, customer records) remains yours - we don't claim ownership of it.

9. Limitation of liability

Aeriva is provided "as is." To the fullest extent permitted by law, we aren't liable for losses arising from reliance on calculations, recommendations, or third-party data provided through the platform, or for service interruptions. Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud, where such limitation isn't permitted by law.

10. Termination

You can stop using Aeriva and request account deletion at any time. We may suspend or terminate accounts that breach these terms, misuse the service, or don't pay for a paid plan.

11. Changes to these terms

We may update these terms from time to time. Continued use of Aeriva after a change means you accept the updated terms.

12. Governing law

These terms are governed by the law of England and Wales.
